At Kingston upon Thames Magistrates’ Court, on Monday 15 October 2007, Mr Ubaid Khan and Mr Mohammed Taqweem Ahsan, the joint proprietors of food premises trading under the name ‘Munch’, at 15 (Basement) Penrhyn Road, Kingston upon Thames, pleaded guilty to 33 allegations that they contravened the requirements of Regulation (EC) No. 852/2004 of the European Parliament and of the Council on the Hygiene of Foodstuffs, which are offences under The Food Hygiene (England) Regulations 2006 and.
The Charges followed a routine food hygiene inspection on the 27 November 2006, when an Environmental Health Officer from Kingston Council considered the condition of the Premises represented an imminent risk of injury to health. The Proprietors agreed to voluntarily close to enable a comprehensive deep clean to be undertaken and so immediate enforcement action was not taken.
However, the Proprietors failed to keep the Premises closed, in order to carry out the deep clean and subsequent inspections over the next few days revealed a continued poor standard of cleanliness and rodent entry points into the Premises. Whilst there were improvements over the following month a further inspection on 8th January 2007 reveal contraventions.
Messrs Khan and Ashan were not represented in Court but pleaded guilty to all the charges at the first opportunity and accepted responsibility for the poor conditions when they appeared before the Kingston Justices on 15 October. The Defendants presented extensive mitigation to the Court and the Court heard how they had since worked with Environmental Health Officers to raise standards of food hygiene at the Premises.
The Court, after taking into account all the circumstances, including the early guilty pleas and their means, fined each of them £200 and ordered them to pay a contribution of £300 each towards the Prosecution’s costs.
Mr Bob Smart, Borough Environmental Health Officer, stated: “We are pleased that the Proprietors of this food business have since taken significant steps to improve the standards and conditions at this business.
“Our aim is always to offer help and advise to local businesses, however where we find serious breaches of the food hygiene requirements that put public health at risk or the proprietors fail to co-operate, the Authority we will not hesitate to take firm action.”
