Advertising Terms & Conditions

Time & Leisure Publishing Ltd (‘The Publisher’) reserves the right to refuse publication of any advertisement without notice or explanation. In these terms the word ‘Advertiser’ shall be construed to include any person or organisation placing an advertisement on behalf of another.

Guarantee of insertion cannot be given and the publishers shall not be liable for any loss or damage caused by any error or inaccuracy in the printing of an advertisement or by the total or partial failure (however caused) of publication or distribution of any publication in which the advertisement is scheduled to appear. In no case shall the total liability of the publisher for any misprint, error, omission or exceed the price charged for the publisher for that advertisement.

Advertisements will be accepted only on the express condition that the advertiser warrants that the advertisement does not in any way contravene any existing legislation and in particular the Trade Descriptions Act 1968 and the Consumer Credit Act 1974.

In the event that copy that is not submitted to the Publisher before the copy deadline, the Advertiser will incur an extra charge of £30 per page affected.

The Publisher will not be responsible for any errors in subsequent insertions which they have not been made aware of. It is the Advertiser’s responsibility to inform the Publisher of any change to copy before the next insertion's copy deadline.

Claims for any error or inaccuracy in the printing of an advertisement must be made within 10 days of publication.

In the case of cancellation of an insertion the advertiser must inform the Publisher in writing, allowing 4 weeks notice before the copy deadline of the insertion. Failure to do so will result in the Advertiser being liable for the full undiscounted cost of the insertion.

Advertisers new to the Publisher must pay in advance of publication until other terms are agreed in writing by the Publisher. Other Advertisers must pay on receipt of an invoice unless credit terms are agreed in writing by the publisher.

Any discount which the Publisher has agreed with the Advertiser will be forfeited in the event of failure by the Advertiser to meet the payment terms.

Accounts that become overdue for payment by 60 days or more from the date of invoice will incur a Finance Charge calculated at the rate of 4% above the Bank of England Minimum Lending Rate. An invoice detailing the calculation of the charge will be issued to each qualifying account.

Advertising Agency commission shall not exceed ten per cent. The commission will not be allowed if the agency fails to meet the payment terms.

All private advertisements and certain categories as laid down by the Publisher must be paid for in advance of publication.

The Advertiser agrees to indemnify the Publisher in respect of all costs, damages or other charges falling down upon the Publisher as a result of any legal action or threatened legal action arising from the publication of the advertisement.

The placing of an advertisement shall amount to an acceptance of these Terms and Conditions and any condition placed on an order by an advertiser shall be null and void insofar as it conflicts with them.

Copyright advertisements produced wholly or partially by the Publisher belong to the Publisher. Advertisers may not reproduce these advertisements without the Publisher's consent.

Advertising may be re-published in other print or electronic media at the Publisher's discretion.

The Publisher shall not be liable for any damage or loss, save as stated in these Terms, and in particular, the Publisher shall have no liability to the Advertiser in any circumstances for any claim for damages to, loss of or costs in respect of anticipated profits, revenues, business opportunities or for any other indirect or consequential loss.

Where an Advertiser instructs/appoints an Advertising Agent to act on their behalf, the Advertiser will remain jointly and severally liable for payment in respect of advertisement(s) should the appointed agent fail to pay. For avoidance of doubt, the agent acts for the advertiser and not the publisher with the agent being responsible for notifying the advertiser of this liability.

Payment by credit card and standing orders will be arranged to be taken from your account on approximately 15th of the month previous to your advert appearing (subject to change).
